Cancellation and Return Conditions

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION / RETURN CONDITIONS
GENERAL:

If you place an order electronically through the website you are using, you shall be deemed to have accepted the preliminary information form and the distance sales contract presented to you.
Buyers are subject to the provisions of Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation (OG:27.11.2014/29188) and other applicable legislation in force regarding the sale and delivery of the product they have purchased.
Shipping costs, which are the delivery expenses of the product, shall be paid by the buyers.
Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, the Buyers may terminate the contract.
The purchased product must be delivered complete, in compliance with the specifications stated in the order, and together with documents such as a warranty certificate and user manual, if any.
If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days from the date it learns of this situation. The total amount must also be refunded to the Buyer within 14 days.


IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

If the Buyer does not pay the price of the purchased product or cancels it in the bank records, the Seller’s obligation to deliver the product shall cease.


PURCHASES MADE THROUGH UNAUTHORIZED USE OF A CREDIT CARD:
If, after the product has been delivered, it is determined that the credit card used by the buyer for payment was unfairly used by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with the shipping costs borne by the SELLER.


IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:
If force majeure events that the Seller cannot foresee occur and the product cannot be delivered on time, the situation shall be notified to the Buyer. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this fee shall be paid to him/her in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels it, the product price shall be refunded to the bank within 14 days from this cancellation; however, it is possible that the bank may transfer it to the buyer’s account within 2–3 weeks.


THE BUYER’S OBLIGATION TO CHECK THE PRODUCT:
The Buyer shall inspect the goods/service subject to the contract before receiving it; damaged and defective goods/services such as dented, broken, torn packaging, etc. shall not be accepted from the cargo company. The delivered goods/service shall be deemed to have been received undamaged and intact. The BUYER must protect the goods/service carefully after delivery. If the right of withdrawal is to be exercised, the goods/service must not be used. The invoice must also be returned together with the product.


RIGHT OF WITHDRAWAL:
The BUYER may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the purchased product to him/her or to the person/organization at the address indicated by him/her, by rejecting the goods without assuming any legal or criminal liability and without giving any reason, provided that the BUYER notifies the SELLER via the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:
If the Buyer has purchased a service, this 14-day period starts from the date the contract is signed. Before the expiry of the right of withdrawal period, the right of withdrawal cannot be exercised in service contracts where the performance of the service has started with the consumer’s approval.
The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.
In order to exercise the right of withdrawal, written notification must be made to the SELLER by registered mail with return receipt, fax or e-mail within 14 (fourteen) days and the product must not have been used within the framework of the provisions of “Products for Which the Right of Withdrawal Cannot Be Exercised” set forth in this contract.


EXERCISE OF THE RIGHT OF WITHDRAWAL:
The invoice of the product delivered to the 3rd party or to the BUYER, (If the invoice of the product requested to be returned is issued in the name of a company, it must be sent together with the return invoice issued by the company. Returns of orders whose invoices are issued in the name of companies cannot be completed unless a RETURN INVOICE is issued.)
The return form, and the box, packaging, and standard accessories of the products to be returned, if any, must be delivered complete and undamaged.


RETURN CONDITIONS:
The SELLER is obliged to return the total amount and the documents that put the BUYER under debt to the BUYER within at most 10 days from the receipt of the withdrawal notification and to take back the goods within 20 days.
If there is a decrease in the value of the goods due to a reason arising from the BUYER’s fault or if return becomes impossible, the BUYER is obliged to compensate the SELLER’s damages in proportion to his/her fault. However, the BUYER is not responsible for changes and deteriorations occurring due to proper use of the goods or product within the withdrawal period.
If, due to the exercise of the right of withdrawal, the campaign limit amount set by the SELLER falls below, the discount amount benefited from within the scope of the campaign shall be cancelled.


PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:
Products prepared in line with the BUYER’s request or clearly in accordance with personal needs and not suitable for return, lower parts of underwear, swimsuit and bikini bottoms, make-up materials, single-use products, goods that are under the risk of rapid deterioration or likely to expire, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated by their nature, goods related to periodicals such as newspapers and magazines other than those provided under a subscription contract, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and audio or video recordings, books, digital content, software programs, devices capable of recording and storing data, and computer consumables cannot be returned in accordance with the Regulation if their packaging has been opened by the BUYER. Also, in accordance with the Regulation, the right of withdrawal cannot be exercised for services whose performance has started with the consumer’s approval before the expiry of the withdrawal period.
Cosmetics and personal care products, underwear products, swimsuits, bikinis, books, reproducible software and programs, DVD, VCD, CD and cassettes and stationery consumables (toner, cartridge, ribbon, etc.) can only be returned if their packaging is unopened, untried, undamaged and unused.


DEFAULT AND ITS LEGAL CONSEQUENCES
If the BUYER falls into default in case of payment by credit card, the BUYER accepts, declares and undertakes that he/she will pay interest within the framework of the credit card agreement with the bank and will be responsible to the bank. In this case, the relevant bank may resort to legal remedies; may demand the costs and attorney’s fee arising from the BUYER, and in any case, if the BUYER falls into default due to his/her debt, the BUYER accepts that he/she will pay the damages and losses suffered by the SELLER due to delayed performance.
